Privacy Policy Adroit Attorneys

  1. We process personal data (data relating to identifiable natural persons) which we receive from you or involved third parties within the scope of the client-attorney relationship or which we collect ourselves. The simple partnership ADROIT Attorneys, Kalchbühlstrasse 4, CH - 8038 Zurich, www.adroit.ch is the controller for the processing of personal data described in this Privacy Policy.
  2. Some of the personal data is provided to us by you or the data subjects themselves, when you or the data subjects contact us by e-mail or telephone. This includes, for example, name and contact details as well as information about the data subject's role at the company or organisation for which you or the respective contact persons work or on whose behalf you or they contact us. We also process personal data that we obtain from our correspondence with third parties (in particular clients, counter-parties, authorities and courts as well as their respective employees) in the context of the client-attorney relationship. In addition, we collect some personal data our-selves, e.g., from public registers, websites or from sources and databases otherwise accessible to us.
  3. We process the aforementioned personal data primarily in order to provide our legal services as well as todocument and invoice such services.
  4. In order to achieve the purposes described in this Privacy Policy, it may be neces-sary for us to disclose personal data to the following categories of recipients: external service providers, clients, counterparties and their legal representatives, business partners with whom we may need to coordinate the provision of legal services, as well as authorities and courts.
  5. Generally, we process personal data in Switzerland. The fulfilment of mandate contracts can, during stays abroad, occasionally also be carried out abroad via remote access by means of secure password protection and the use of our own devices, which are adequately protected from access by third parties, from the place where the processing person is staying at such given time. In addition, we may transfer personal data to recipients (namely clients, counterparties and their legal representatives, business partners with whom we may need to coordinate the provision of legal services, as well as authorities and courts) who process the personal data in other countries, including such countries that do not ensure a level of data protection comparable to Swiss law. The latter will only be done based on the consent of the client or, if necessary, for the performance of a contract or the enforcement of legal claims.
  6. We store personal data for as long as necessary to process and fulfill the mandates with our clients, for as long as there is a legal obligation to retain and document the data, or for as long as we or our clients have an overriding private or public interest in doing so (e.g., for documentation and evidence purposes). We take reasonable and appropriate precautions to protect personal data from loss, unauthorised modification or unauthorised access by third parties. If you provide us with personal data concerning third parties (e.g., your employees or other contact persons), you are required to inform them in general terms about the processing by legal service providers (such as us) or other external service providers (e.g., in a privacy policy for employees).
  7. Please note that, within the framework of our mandates, we use external IT and telecommunication service providers as well as cloud providers with servers in Switzerland. We also use certain IT services as well as means of communication which may be associated with data security risks (e.g., e-mail, video conferences). It is your responsibility to inform us of your wish for particular security measures.
  8. The processing is necessary so that we can fulfil our contractual obligations to you or our legal obligations (e.g., retention obligations).
  9. As a rule, data subjects may have a right to information from us as to whether and what data we process and the purpose of the data processing, the right to have their personal data corrected and/or erased and/or its processing restricted, the right to object to the processing, the right to lodge a complaint with the competent supervisory authority and the right to data transfer/transferability. However, please note that these rights are subject to prerequisites, conditions and exceptions. Where legally permitted to do so, we may refuse requests to exercise these rights.
  10. No consent to this Privacy Policy is required from the client, their employees or other contact persons. This Privacy Policy is merely an information about the nature, scope and purpose of the use of personal data by ADROIT Attorneys. ADROIT Attorneys reserves the right to unilaterally change the content of this Privacy Policy at any time and without any notice. It is, therefore, recommended that you regularly check the Privacy Policy on our website www.adroit.ch.
  11. If you have any questions or if you or your employees or other contact persons would like to exercise their data subject rights, please contact us at info@adroit.ch or write to ADROIT Attorneys, Kalchbühlstrasse 4, CH - 8038 Zurich.
